Supreme Court clears way for employment lawsuit against Halliburton

The justices ruled unanimously that a lower court could reopen the legal challenge under a procedural rule.

A former employee at Halliburton Energy Services scored a preliminary victory before the Supreme Court on Wednesday, clearing the way for him to pursue a lawsuit against the energy company.

The high court unanimously found that Gary Waetzig could revive a dismissed lawsuit against Halliburton for alleged age discrimination.

Waetzig had asked the court to reopen the case under a federal procedural rule — Rule 60(b) — which allows a court to provide relief of a final judgment, order or proceeding, if certain criteria are met.

In this case, Waetzig had asked a Colorado district court to dismiss his lawsuit before Halliburton had answered his complaint in court, meaning he retained the ability to refile the case at a future date.
