THE BROOKS SURVEY COMPETITION TO WIN A 1 of 3 PAIRS OF BROOKS SHOES (THE “PRIZE DRAW”)

1. Introduction

1. The Prize Draw is organised and run by Brooks Sports Ltd. (“Brooks”), who can be contacted at Eagle Court 2, Hatchford Way, Birmingham, B26 3RZ, United Kingdom.  
2. By entering this Prize Draw you agree to these Terms and Conditions (the “Terms”) and any decisions reached by Brooks, which are final and binding in all matters related to this Prize Draw.
3. The Prize Draw starts at 00:00 on 21^st June, 2023 (GTM) and ends on 30^th June, 2023 (GTM) (the “Prize Draw Period”).

2. Who can enter this Prize Draw?

2. Be residents of, with a postal address in, The United Kingdom and Ireland.
3. Be aged 18 or over.
4. The Prize Draw is not open to directors, members, partners, employees, agents or consultants of Brooks, any person who directly or indirectly controls or is controlled by Brooks, or any supplier of goods or services in connection with the Prize Draw, or their spouses, life partners, business partners or immediate family members.
5. By entering the Prize Draw you hereby warrant that all information submitted by you is true, current, and complete. Brooks reserves the right to verify the eligibility of all participants and disqualify a participant for submitting false information.

3. How does the Prize Draw work?

1. No purchase is necessary to enter the Prize Draw and entry is free.
2. To be eligible to enter the Prize Draw during the Prize Draw Period, participants must:
3. Enter the Prize Draw by completing the Brooks survey and submitting your response to complete the Prize Draw form online via the URL provided.
4. Entry forms must be completed before the end of the Prize Draw Period.
5. Each participant can enter the Prize Draw once. Only the first Entry by each participant will be accepted and will constitute a valid Entry.
6. All Entries must be received by Brooks during the Prize Draw Period, or they will be void. Brooks will not accept responsibility for:
7. Prize Draw Entries that are lost, mislaid, damaged, or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
8. Any change in dates, times or cancellations or other arrangements that may prevent a winner from accepting, taking or using a prize.
9. On or after 30^th June 2023, 3 individual winners will be selected by Brooks to win 1 pair of Brooks shoes each (excluding the Hyperion Elite) and subject to availability from all valid Entries received using a random computer-generated process.
10. The winners will be notified on or after 30^th June 2023 via the email address they used to enter the Prize Draw (“Notification”).
11. The Prize must be claimed in accordance with the instructions in the Notification message, within seven (10) days of the Notification (the “Claim Period”). In order to receive their Prize, the winners will also need to provide Brooks with any further information requested by Brooks, in accordance with the instructions set out in the Notification within this Claim Period. Failure to claim the Prize in accordance with the instructions in the Notification within the Claim Period will result in the forfeit of the Prize and an alternative winner will be chosen.
12. The winners will receive the Prize within thirty (30) working days of the date they provide Brooks with the information requested in the Notification (as set out in clause k).
13. The winners may be required to provide Brooks with proof of identification in order to verify compliance with the eligibility requirements for the Prize Draw.
14. If any winner is found to be ineligible or fails to comply with the Terms, then that winner may, at Brooks’ sole discretion, be disqualified and an alternate winner will be selected. This will also be applied to team entries.

4. What is the Prize?

1. There will be 3 individual winner’s total.
2. Each winner will win 1 pair of Brooks shoes – excluding the Hyperion Elite.
3. The choice of shoe and colour is subject to availability. 
4. Prizes are non-transferable, non-exchangeable and have a cash value of zero. Prizes are for personal use only and are not for resale. Prizes may be forfeited in the event that Brooks determines that the prize is being misused. 
5. Brooks reserves the right to substitute a prize with another of an equal or greater value at its absolute discretion. 

5. General

1. Brooks reserves the right to amend the rules of the Prize Draw, to withdraw the Prize Draw at any time if circumstances beyond its control make this unavoidable, or to cancel the Prize Draw in the event of non-compliance with these Terms.
2. Brooks will use your personal details to contact you for administrative purposes relating to this Prize Draw.
3. If you have elected to be added to Brooks’ email database, you will also receive promotional emails with offers, news, products, and information. You can unsubscribe at any time.
4. Brooks will keep your personal information safe and will use your personal information in accordance with the privacy policy available on its website (https://www.brooksrunning.com/en_us/privacy/privacy-policy.html)
5. Each winner’s surname and county will be made public. Each winner will have the right to object to this information being published or to request a reduction in the amount of information being published. Brooks may be required to provide this information to the relevant regulatory authorities.
6. The decision of Brooks regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.
7. Any cancellation or changes will be posted on the relevant Prize Draw landing pages, as set out in clause 3c.
8. With the exception of liability which cannot be excluded by law, Brooks is not liable for, and you release Brooks from, liabilities relating to any direct or indirect loss or damage which is suffered as a result of entering the Prize Draw, failing to win, winning, accepting, or using a Prize.
9. This Prize Draw is run by Brooks, it has no affiliation with parkrun, and they have no liability whatsoever for the running of this Prize Draw. Any complaint about the Prize Draw should be directed to Brooks and not parkrun. If you require any help or have any enquiries relating to these Terms, please contact Brooks at the address above.

By agreeing, you agree that your name, company, title and profile picture are displayed to other participants who have also chosen to display their information in the participant list. If you do not consent, you will not be able to see or be seen by others on the list. Consent is required to access the participant list.
